The 309 Partner Visa (Subclass 309) is a temporary visa that allows you to live, work and study in Australia while your permanent Partner Visa (Subclass 100) is being processed.
To be eligible, you’ll need to be the spouse or de facto partner of an Australian citizen, Australian permanent resident or eligible New Zealand citizen.
The 309 Visa is for applicants who are outside Australia at the time of application (with the 820 being for applicants in Australia.) This is why it’s sometimes referred to as the “offshore partner visa”.
When you apply for a 309 Partner Visa, you are also applying for the permanent 100 Partner Visa at the same time.
You’ll first be granted the temporary 309 visa. Once approved, you’ll be able to enter Australia and:

Travel to and from Australia as many times as you like

Take part in free English language classes through the Adult Migrant English Program, if eligible

Access Australia’s public health care system, Medicare
After two years, you may become eligible for the permanent 100 visa. If you’ve already been married or in a de facto relationship for three or more years (or two years with a child), you may be granted the permanent 100 visa at the same time as your 309 visa.
Once the permanent visa is granted, you’ll have the right to live and work in Australia indefinitely.
