What is an 801 Partner Visa?

The Subclass 801 Partner Visa is a permanent visa that lets you live, work and study in Australia.

To be eligible, you must be the spouse or de facto partner of an Australian citizen, permanent resident or eligible New Zealand citizen. Other requirements also apply.

You apply for the permanent 801 Visa at the same time as the temporary 820 Visa.

In most cases, two years after you submitted your application for the 820 Visa, Immigration will ask you to provide further documents to assess your eligibility for the 801. If you’ve been in a relationship for more than three years, or for over two years if you share a child together, you might be granted both visas at the same time.

Once granted, the 801 Visa gives you Australian permanent residency. You’ll be able to live, work and study in Australia without restrictions.

How long does the 801 Partner Visa take to process?

The Department of Home Affairs currently estimates the following average processing times (as of Jan 2023):

25% of applications:

processed in: 6 months

50% of applications:

processed in: 10 months

75% of applications:

processed in: 17 months

90% of applications:

processed in: 25 months

These are only average estimates. Applications can take longer if information is missing or further assessment is needed.

What are the 801 Partner Visa requirements in Australia?

To be granted the 801 Partner Visa, you must:

  • Be in or outside Australia when the visa is granted
  • Hold a Subclass 820 Partner Visa or a Subclass 445 Dependent Child Visa
  • Have held your 820 Visa for at least two years (exceptions apply)
  • Be able to show your relationship is still genuine and ongoing. This is assessed based on four key factors
  • Have lived together for at least 12 months as a de facto couple, if you’re not married. [Exception: If you live in QLD, ACT, NSW, SA or VIC, you may be able to bypass the 12 month rule by registering your relationship]
  • Pass the required health assessments (some waivers may apply)

Provide police checks for every country you’ve lived in for 12 months or more, within the last 10 years

When can I apply for the 801 visa?

You can apply two years after lodging your 820 visa application.

Yes, as a permanent resident, you can travel freely. However, if you plan to be outside Australia for a long time, you may need to apply for a Resident Return visa to make sure you can re-enter the country.

If your relationship ends before your 801 visa is granted, you may still be eligible in some situations, such as if you’ve experienced family violence or have custody of children from the relationship.
