What is an Australian Partner Visa?

A Partner Visa starts with a temporary visa and then moves to permanent residency if your relationship remains genuine and ongoing.

There are three main visa paths:

Onshore (inside Australia)

Apply for the 820 (temporary) visa first, then the 801 (permanent) visa, usually two years later.

Offshore (outside Australia)

Apply for the 309 (temporary) visa first, followed by the 100 (permanent) visa, usually two years later.

Prospective marriage (Subclass 300)

For those who are not yet married and live outside Australia, to come and marry their partner here.

In some cases, you may receive the permanent partner visa immediately if you’ve been married or in a de facto relationship for three or more years, or for two or more years if you have a child together.

What are the Partner Visa requirements?

  • You and your partner must meet relationship criteria such as being married or in a genuine de facto relationship
  • You need to be sponsored by your partner, who must be an Australian citizen, permanent resident, or eligible New Zealander
  • You must provide strong evidence of your relationship such as joint bank accounts, lease agreements, shared expenses and communication proof
  • Health and character checks are required for both applicant and sponsor
  • Your location when applying determines whether you’re eligible for an onshore or offshore pathway
  • Prospective Marriage Visa applicants must eventually marry their sponsor in Australia

What will happen when you apply for a Partner Visa?

Stage 1

You apply for the temporary visa

Subclass 820 if you’re onshore, or Subclass 309 if offshore

Stage 2

Submit evidence for the permanent visa

Two years later (unless automatically granted for some long-term relationships), you will need to submit additional evidence for assessment for the permanent visa: Subclass 801 or Subclass 100

Stage 3

Your temporary visa remains valid until your permanent visa is granted

You may get your permanent visa right away if you have been married or been in a de facto relationship for 3 or more years, or have a child together.

What are the eligibility requirements for a Partner visa?

You must be married, engaged, or in a de facto relationship with an Australian citizen, permanent resident, or eligible New Zealand citizen. You’ll also need to show that your relationship is genuine and ongoing. Each visa subclass has different requirements, so check the relevant page for details.

Immigration case officers assess Partner visas based on four key areas. You’ll need to provide evidence in each of these:

  1. Financial aspects
    Show you share financial commitments, like joint bank accounts, shared bills, and financial support.
  2. Nature of household
    Prove you’ve established a shared home. This can include joint lease agreements, utility bills in both names, or proof of living together.
  3. Social context
    Demonstrate that your relationship is known and accepted by friends and family. Photos together, social media interactions, and invitations can help support this.
  4. Nature of commitment
    Show that you rely on each other emotionally and for long-term companionship. Communication records like phone calls, messages, or evidence of significant shared experiences are great examples.

Processing times vary. Right now, 75% of 309 visas are processed within 16 months. The 100 visa is usually assessed two years after you apply, but you may be approved sooner if you meet certain criteria.
