Yesterday, it was announced that same-sex couples can now get legally married in Australia. What does this historic change mean for you?
If you are in a same-sex relationship, and your partner is Australian/wants to settle in Australia, doors have widened for you!
Previously, the only way same-sex couples can obtain a partner visa is if you apply as a de facto couple, which means you must have lived together for 12 months (or register your relationship in Australia). Also, even if you’re married overseas, Australia would not recognise your marriage.
Now, same-sex couples can also apply for a partner visa even if you have not yet lived together for 12 months.
Furthermore, if you’re already married overseas, your marriage is now recognised under immigration law! This could potentially speed up your journey to PR by almost a year!
Of course, you will still need enough evidence to meet the ‘joint household’ criterion, which means in most cases you will need to have lived together for some time.
